TakeSmith Terms of Service

Effective September 14, 2026. These terms explain the conditions for using TakeSmith and its website, support, and private beta services, provided by Webbori.

1. About these terms

By using the TakeSmith website or requesting our support or beta services, you agree to these terms. If you do not agree, do not use those services. You must be legally able to agree, or use them with the involvement of a parent or guardian who can agree for you.

The TakeSmith iOS app is licensed under Apple's Standard End User License Agreement and the applicable App Store terms. These website terms explain related services and responsibilities; they do not replace that app license or reduce any rights you have under it. The app license controls if there is a conflict about the license or use of the app.

2. What TakeSmith provides

TakeSmith helps you select moments from supported media, keep projects, and prepare still images and Capture Cards. Available versions may also offer burst photo import, editing, repair, edit history, and sharing tools. Features depend on the app version, device, operating system, source media, and destination app. A feature in a TestFlight build may not be available in the App Store version.

The current app does not require a Webbori account and has no subscriptions or in-app purchases. Download availability and any displayed download price are shown in the App Store. Apple or other providers may charge for storage, connectivity, or services you choose separately.

3. Your media and rights

You retain your rights in the source media you import and the content you create. Webbori does not acquire ownership of your media or exports because you use TakeSmith. You are responsible for having the rights and permissions needed to import, edit, save, and share that content, including permission to use another person's image or copyrighted work where required.

Media processing takes place on your device, with project storage through your device or Apple iCloud as described in the Privacy Policy. These terms do not give Webbori permission to publish your private media or use it for AI model training. If you send an example to support, you permit us to use that example to investigate and answer your request.

Webbori and its licensors retain rights in the TakeSmith software, website, branding, and supplied materials. These terms do not grant permission to represent yourself as Webbori or use our branding as your own. Third-party materials remain subject to their applicable rights and notices.

4. Responsible use

Use TakeSmith and the website lawfully and respect other people's privacy and intellectual property. Do not use them to distribute unlawful content, impersonate someone deceptively, harass others, or violate their rights.

Do not interfere with the website, submit malicious code, misuse invitation codes, evade access restrictions or rate limits, or attempt unauthorized access to another person's information or our systems. This does not limit activity that applicable law expressly permits.

5. Review exports and sharing choices

Best Moments scores, edit suggestions, and repair results are aids to your judgment. They may be incomplete or unsuitable for a particular image. Editing and image processing can change the appearance of a moment. Review the result before relying on or sharing it, especially where accuracy or authenticity matters.

Preserve, Social Safe, and No Metadata control supported embedded capture metadata in the exported file. Social Safe removes embedded precise location; it can retain other capture details. These modes do not remove information visible in the image, erase source or project data, or prevent a receiving app from adding its own information. Check both the image and its metadata before sharing.

You choose when to save or share. Where available, Instagram feed sharing saves a JPEG copy to Photos before opening Instagram; that copy remains even if posting is canceled. Story sharing uses a temporary local pasteboard image. Other sharing routes use iOS handoff controls. You complete any publication in the receiving app. We cannot guarantee that a destination will accept an image, preserve its quality or metadata, or keep it private.

6. Storage, backups, and deletion

Projects use your Apple iCloud storage when available, with local app storage as a fallback. Projects may include copied source media, metadata, notes, edits, generated images, and history. Storage availability and synchronization depend on your device, connection, Apple Account, iCloud settings, and available space.

Keep independent copies of important originals and exports. Synchronization is not a guarantee of backup or recovery. Deleting a project can remove its stored package and affect its availability on devices using the same iCloud storage. Removing the app may leave iCloud projects behind, and deleting a project does not remove original Photos assets, saved exports, or copies held by recipients.

7. Privacy and external services

Our Privacy Policy describes data handling for the app, website, support, and beta access. Read it for details about Photos permissions, iCloud, Apple Maps requests, sharing, and the information you submit to us.

Apple Photos, iCloud, Maps, the App Store, TestFlight, and any destination apps have their own terms and privacy practices. Apple Maps can load a map for a source capture location when an export preview opens, even if the export's location metadata is removed. Maps and capture details are informational and may be inaccurate.

Third-party services can change or become unavailable. Webbori does not control their operation or the actions of recipients after you share an export.

8. Private beta access

Beta access is invitation-only when offered. Submit an email address you control and an invitation code issued for your use. Requesting an invitation does not guarantee eligibility, delivery, continued access, or a future release.

Beta software may be incomplete, change, expire, or behave unexpectedly, including with stored projects. Use copies of important media. Apple distributes beta builds under its TestFlight terms. We may limit or end beta access to manage testing or address misuse.

9. Availability and responsibility

We aim to keep the website and support useful, but do not promise uninterrupted access, a particular response time, compatibility with every file or destination, or error-free results. To the extent permitted by law, the website and related support and beta services are provided as available, without additional warranties of accuracy, fitness for a particular purpose, or uninterrupted operation. App warranties and remedies are governed by the applicable app license.

To the extent permitted by law, Webbori is not responsible for indirect or consequential losses arising from the website or related services, including lost profits or opportunities. Nothing here excludes responsibility for fraud, willful misconduct, gross negligence, injury where liability cannot be excluded, or any other liability that the law does not allow us to limit. Your mandatory consumer rights and remedies remain intact.

10. Changes and ending use

You may stop using the website and related services at any time. We may restrict website or beta access when reasonably needed to address a violation of these terms, protect the service, or comply with law. This does not give us remote access to erase your private project library. Ending an app license is governed by its own terms.

We may update these terms as the service changes. We will post the revised terms with an effective date and provide additional notice or obtain agreement where required by law. Changes apply prospectively. If a provision cannot be enforced, the remaining provisions continue to apply to the extent permitted by law.

11. Questions and disputes

Contact Webbori at [email protected] with questions, concerns, or a request to resolve a problem. You retain any rights to bring a claim in a court or before an authority available under applicable law. These website terms do not impose mandatory arbitration or waive class-action rights.
